Custody Over an Illegitimate Child

"X" is a father of a 2-year old baby girl.  He and the mother of their baby were former live-in partner here in General Santos City.  They were supposed to get married, however, his common-law wife had eloped with another man.  Worse, she brought with her their baby girl.  Thus, "X" came to our office and asked some advice whether he could have custody over their common child.

Man as a Rape Victim?

It is usual in our society that when it comes to rape cases, it is usually a female who is a rape victim.  In fact, most of the rape cases filed in court are against men.  I bet you do not hear nor see in the news yet that a man files a rape case against someone.

Now the questions are, could a man be a victim of rape?  Could a man file a rape case against another in court?

VAWC - Violence Against Women and Their Children Act of 2004

Considering that I handle cases falling within the jurisdiction of a Family Court, almost every now and then, clients are referred to me involving cases of violence against women and their children.  This law may be not favorable to men but it is the law.  The law may be harsh but it is the law.  Dura lex sed lex.

For the benefit of those who follow and visit my blog, I will try to explain simply the basic features of this law or better known as Repuclic Act Number 9262 or an Act Defining Violence Against Women and Their Children.
