Accidental or Intentional?


Just two weeks ago, I was surprised when my colleague told me that he noticed something wrong in my toy car.  He asked whether I figured in an accident that resulted to its damage.  I did not remember I bumped into something or vice versa.  Considering the extent of the damage, it would be impossible that one cannot notice it nor feel its impact.

You may be the judge, is it accidental or intentional?

Simulation of Birth

Spouses X and Y are married for almost 10 years.  However, no matter how they try, they still were unable to have a child.  Z was a neighbor of spouses X and Y.  Z was impregnated by his boyfriend U who refused to acknowledge the child.  Thus, Z was left with no choice but to face the consequences on her own.  However, Z has no means to finance her child even to shoulder any expenses when she would give birth to him.

Recently, some provisions of the Republic Act No. 8485 or otherwise known as  "The Animal Welfare Act of 1998" has been amended.  The amendments of this law are espoused in Republic Act No. 10631.

For this post, I will provide what are the salient features of the said amending law.

Implementing Rules and Regulations of Republic Act No. 10627, Otherwise Known as the Anti-Bullying Act of 2013

Bullying is one of the pressing issues we are facing today.  In almost every nook and corner of this country, bullying may be happening.  Sad to note, most of the victims are students who are so powerless and have no courage to vent out what they have been through.  Thus, R.A. No. 10627 or otherwise known as the Anti-Bullying Act of 2013 has been enacted basically to protect our society from bullying and ultimately to punish the actors.

Philippine Standard Time Act of 2013

To have a very fruitful 2014, I guess, we have to start doing the right things.

Basic of these is to help campaign the government in promoting our very Philippine Standard Time.  As a matter of fact, a law has been signed by President Benigno S. Aquino on May 15, 2013 known as Philippine Standard Time (PST) Act of 2013 or otherwise known as Republic Act No. 10535.

Accordingly, all the national and local government offices shall display the Philippine Standard Time (PST) on their official time devices, including bundy clocks, in accordance with the official time being provided by the Philippine Atmospheric, Geophysical and Astronomical Services Administration (PAGASA) using its network time protocol.

Custody Over an Illegitimate Child

"X" is a father of a 2-year old baby girl.  He and the mother of their baby were former live-in partner here in General Santos City.  They were supposed to get married, however, his common-law wife had eloped with another man.  Worse, she brought with her their baby girl.  Thus, "X" came to our office and asked some advice whether he could have custody over their common child.

Man as a Rape Victim?

It is usual in our society that when it comes to rape cases, it is usually a female who is a rape victim.  In fact, most of the rape cases filed in court are against men.  I bet you do not hear nor see in the news yet that a man files a rape case against someone.

Now the questions are, could a man be a victim of rape?  Could a man file a rape case against another in court?

Considering that I handle cases falling within the jurisdiction of a Family Court, almost every now and then, clients are referred to me involving cases of violence against women and their children.  This law may be not favorable to men but it is the law.  The law may be harsh but it is the law.  Dura lex sed lex.

For the benefit of those who follow and visit my blog, I will try to explain simply the basic features of this law or better known as Repuclic Act Number 9262 or an Act Defining Violence Against Women and Their Children.

On Manny Pacquiao's Taxable Income

Recently the issue of PDAF, DAP, Janet Lim Napoles and anything related thereto, has been clouded by the order of garnishment issued by the Court of Tax Appeals on our very own boxing hero Manny Pacquiao's bank account.

What is this all hullabaloo about?  I hope this simple insight would give us any idea and information so as not to be misled by what are fed to us.  After all, the issue of Manny Pacquiao is also the issue of a common Filipino.

REPUBLIC ACT No. 10591: AN ACT PROVIDING FOR A COMPREHENSIVE LAW ON FIREARMS AND AMMUNITION AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF

In case you do not know, I have posted herein the new law providing for a comprehensive law on firearms and ammunition and providing penalties for violations thereof. This law provides for a graver penalties to those who possessed unlawfully the firearms.  This is basically to inform all the people who wish to visit and be informed and kept updated. Legal Advice

My client asked me if she could a charge a criminal case to a person who has borrowed a sum of P 90, 000.00 from her.

Her situation is very common to all of us.  Thus, I post this advice here on my blog to at least inform who would be reading this.

First, you cannot file a CRIMINAL CASE against your borrower. There is no criminal ground to indict the borrower.  As a matter of fact, it is no less than our very own Constitution that provides that no person shall be imprisoned for debt.
